Tenant rights in Albania: what you need to know

Albanian Civil Code (articles 801–820 on rentals) protects you more than most tenants realize. Here are the five key rights.

1. Written contract: required only for terms over 9 years

The law doesn't require a written contract for rentals under 9 years, but strongly recommended. Without one, any dispute becomes "your word vs theirs". The contract protects the landlord too.

2. Your deposit must be returned

The landlord can only deduct sums for real damage — not "normal wear and tear". Normal wear = wall scuffs, a worn-out hinge, lightly used washing machine. Real damage = broken glass, large holes, ruined doors.

If withheld without cause, you can file a civil suit (a simple case runs €100–300 in legal fees).

3. The landlord can't enter without notice

Not for "inspection", not for "repairs". Written notice (SMS/email is enough) at least 24 hours ahead is required, and you can refuse if the timing doesn't work. Exception: emergencies (water leak damaging neighbors).

4. The landlord can't raise the rent mid-contract

If the contract says "€500 for 12 months", the landlord CANNOT demand more before that period ends. At renewal time it can be renegotiated. You can refuse the increase — but you can't leave without notice either.

5. You can leave with notice

Typical contracts have a 30-day notice clause. If not specified, the law defaults to 3 months. You pay rent normally during that notice period.
